1. USER INFORMATION

Who is the controller responsible for processing your personal data?

Agencia Figu Canarias, S.L. is the CONTROLLER for the processing of the USER’s personal data and informs you that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

For what purposes do we process your personal data?

At Agencia Figu Canarias, S.L., we process your personal data for the following purposes:

Management of commercial and professional relationships: To maintain a commercial relationship with users, clients, supporting artists (extras), actors and collaborators. This includes managing requests, quotes, service contracts and handling enquiries made through the forms available on the website.
Selection and management of artistic profiles: For the receipt, evaluation and management of applications from supporting artists, extras and actors, including the creation of profiles and portfolios for their participation in audiovisual projects.
Sending commercial communications: With the data subject’s consent, to send commercial and promotional communications related to our services and activities, by electronic or physical means.
Compliance with legal obligations: To comply with applicable legal obligations, such as those related to labour, tax and social security regulations.
Statistical analysis and market research: To conduct market research and statistical analysis that allow us to improve our services and adapt them to the needs of our clients and collaborators.

The lawful basis for processing your data is the consent you provide by accepting our privacy policy, as well as compliance with legal obligations and the performance of a contract or pre-contract.

On what grounds can we process your personal data?

The processing of your personal data is lawful under Article 6 of the General Data Protection Regulation (GDPR) as follows:

With the express consent of the user (Art. 6.1.a and, where applicable, Art. 9.2.a GDPR): For the receipt, management and processing of CVs, photographs, videos and personal data included in applications for supporting artist roles, acting jobs or other professional profiles linked to audiovisual productions. Also for sending informational or commercial communications related to our services.
For the performance of a contract or the implementation of pre-contractual measures (Art. 6.1.b GDPR): When you participate in selection processes, formalise collaborations or contracts, or request services through the website.
To comply with legal obligations (Art. 6.1.c GDPR): Regarding compliance with tax, labour, social security regulations or others derived from human resources management or the provision of services.
For the legitimate interest of the controller (Art. 6.1.f GDPR): To carry out statistical analysis, market research and manage enquiries voluntarily made by users, provided that the rights of the data subject do not prevail.

How long will we retain your personal data?

They will be retained for no longer than necessary to maintain the purpose of the processing or while there are legal requirements dictating their custody. When they are no longer necessary for this purpose, they will be erased using appropriate security measures to guarantee either the anonymisation of the data or their total destruction.

Who do we share your personal data with?

No communication of personal data to third parties is planned unless necessary for the development and execution of the purposes of the processing, in which case data may be shared with our communications service providers. The CONTROLLER has signed the confidentiality and data processing agreements required by current privacy regulations with these providers.

What are your rights?

The rights available to the USER are:

Right to withdraw consent at any time.
Right of access, rectification, portability and erasure of their data, and the restriction of or objection to its processing.
Right to lodge a complaint with the supervisory authority (www.aepd.es) if they consider that the processing does not comply with current regulations.

2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER

USERS, by ticking the corresponding boxes and entering data into fields marked with an asterisk (*) in the contact form or presented in download forms, expressly, freely and unequivocally accept that their data is necessary for the provider to meet their request, with the inclusion of data in the remaining fields being voluntary. The USER guarantees that the personal data provided to the CONTROLLER is true and assumes responsibility for communicating any modification thereof.

The CONTROLLER informs that all data requested through the website is mandatory, as it is necessary to provide an optimal service to the USER. If all data is not provided, there is no guarantee that the information and services provided will be completely tailored to your needs.

3. SECURITY MEASURES

In accordance with the provisions of current regulations on personal data protection, the CONTROLLER is complying with all provisions of the GDPR and LOPDGDD regulations for the processing of personal data under its responsibility, and manifestly with the principles described in Article 5 of the GDPR, whereby they are processed lawfully, fairly and transparently in relation to the data subject and are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

The CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures established by the GDPR and the LOPDGDD in order to protect the rights and freedoms of USERS, and has provided them with the appropriate information so that they can exercise them.
